Morning Muze — Terms of Use

Effective Date: May 1st, 2026

1. Acceptance of Terms

Welcome to Morning Muze. By using the Morning Muze mobile app or services (“App” or “Service”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Service.

Important: These Terms contain a binding arbitration agreement and class action waiver in Section 15. Please read them carefully. You have the right to opt out of arbitration within 30 days of first accepting these Terms.

2. Description of Service

Morning Muze provides a personalized, audio-first alarm experience. Users can:

  • Record their own wake-up messages
  • Request messages from friends
  • Subscribe to content from creators

Some features are free; others require a paid subscription managed through RevenueCat and billed by Apple App Store or Google Play. A portion of subscription revenue is paid to creators after settlement of those funds by Apple or Google.

3. User Accounts

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity under your account.
  • You may delete your account and associated data at any time from within the app.
  • Notify us immediately of any unauthorized access or use.

4. Acceptable Use

You agree not to:

  • Upload or transmit content that is unlawful, offensive, harassing, hateful, obscene, infringing, or otherwise objectionable
  • Violate any applicable law or regulation
  • Transmit unauthorized ads, spam, or malicious software
  • Interfere with or disrupt the Service, its servers, or networks

Audio content in user-to-user messages. When you record or send an audio message to another user, you agree that the recording will not:

  • Contain sexually explicit content, or content sexualizing minors
  • Contain threats of violence, harassment, or bullying directed at the recipient or any third party
  • Contain slurs or content targeting a person or group based on race, ethnicity, religion, sex, gender identity, sexual orientation, disability, or other protected characteristics
  • Infringe the intellectual property rights of others (such as recordings of copyrighted music or other protected works)
  • Be designed to deceive, defraud, or impersonate another person
  • Violate applicable law

Reporting messages. User-to-user audio messages are deleted from our servers upon delivery. If you receive a message that you believe violates these Terms, you may report it by contacting support@morningmuze.com. We may suspend or terminate the accounts of users who send content in violation of these rules.

Creators publishing audio content to subscribers are additionally subject to the Morning Muze Creator Content Guidelines available at morningmuze.com/creator-guidelines.

5. Content & Intellectual Property

Your content. You retain ownership of the content you upload or record.

License to us. By uploading, you grant Morning Muze a worldwide, royalty-free license to host, store, reproduce, distribute, and deliver your content within the App and Service.

Responsibility. You are solely responsible for your content. Morning Muze is not liable for user-submitted material.

Our IP. The app design, features, and code are the property of Morning Muze and/or its licensors.

5A. Creator Content and Subscriptions

Subscriptions to a creator provide access to that creator’s existing and future library of alarm messages while the subscription is active.

Any posted release schedule (e.g., “new content every Monday”) is for informational purposes only and is not a guarantee of delivery frequency or volume. Creators may add, remove, or modify content at their discretion, and may pause or end their participation in the Platform at any time. These actions do not affect the subscription price.

Creators are solely responsible for the content they create, publish, and any commitments they make to their subscribers. Morning Muze does not guarantee the fulfillment, frequency, quality, or continued availability of creator content, and does not enforce or validate creator schedules.

Refunds for creator subscriptions. All subscription billing is handled by Apple App Store or Google Play, and refund requests are processed by those platforms under their respective policies. Morning Muze does not hold subscription funds directly and cannot issue refunds outside of those platforms. Dissatisfaction with the volume, frequency, or quality of creator content is not a basis for a refund issued by Morning Muze. Users seeking a refund should contact Apple or Google directly.

5B. Content Moderation

Morning Muze may review user-submitted and creator-submitted content for compliance with these Terms and our Creator Content Guidelines (available at morningmuze.com/creator-guidelines). We may remove content, suspend accounts, or terminate the Creator Agreement at our discretion when content violates these Terms, the Creator Content Guidelines, applicable law, or the policies of Apple or Google.

We may act on reports from users, automated detection, or our own review. We are not obligated to monitor all content and our decision not to remove specific content does not mean it complies with these Terms.

5C. Copyright and DMCA

Morning Muze respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). We will respond to clear notices of alleged copyright infringement, may remove content alleged to infringe, and may terminate accounts of repeat infringers.

Notices that do not substantially comply with the DMCA may not be acted upon. Knowingly submitting false claims may result in liability under 17 U.S.C. § 512(f).

6. Privacy

Your privacy is important to us. Please review our separate Privacy Policy, which explains how we collect, use, and share information.

7. Subscriptions & Payments

  • Subscription payments are managed by RevenueCat through the Apple App Store or Google Play in-app purchase systems.
  • Morning Muze does not directly store or process payment information.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
  • You can manage or cancel your subscription at any time through your App Store or Google Play account settings.
  • Deleting the app does not cancel your subscription.
  • Refunds, cancellations, and billing disputes are handled by Apple or Google in accordance with their respective policies. Morning Muze cannot issue refunds for purchases made through the App Store or Google Play.

8. Safety; Alarms Are Not a Sole Safeguard

Morning Muze is intended to make mornings more intentional, not to serve as a critical safety device.

Do not rely on the App as your sole means of waking up for safety-critical activities, including but not limited to medical appointments, medication schedules, work shifts, travel, or any situation where failure to wake on time could result in harm. You should always set a backup alarm using a separate device or method.

Alarms may fail to sound or sound at incorrect times for many reasons outside Morning Muze’s control, including but not limited to: device settings (Silent mode, Do Not Disturb, Focus modes, volume), low battery, lost network connectivity, audio session interruptions, operating system updates, force-quitting the App, or device hardware issues. Morning Muze is not liable for missed or incorrectly delivered alarms.

9. Modifications to the Service

We may modify or discontinue parts of the Service at any time without prior notice.

10. Account Termination

Termination by you. You may terminate your account at any time by using the in-app delete option. Termination does not entitle you to a refund from Morning Muze. To cancel an active subscription, you must do so through your Apple App Store or Google Play account.

Termination for cause by Morning Muze. We may suspend or terminate your account immediately, without notice, if you violate these Terms, the Creator Content Guidelines, or applicable law, or if your account presents a safety, security, or legal risk to Morning Muze or its users. In such cases, no refund will be issued by Morning Muze, and any pro-rata refund of subscription fees must be sought from Apple or Google.

Termination for convenience by Morning Muze. We may also terminate your account or discontinue the Service at our discretion on at least 30 days written notice (which may be delivered via email or in-app message). In this case, you may cancel any active subscription through Apple or Google to seek a pro-rata refund under their policies.

Effect of termination. Sections 5 (the license you grant us, limited to existing distribution), 8, 11, 12, 13, 15, and 16 survive termination.

11. Disclaimers

The Service is provided “as is” and “as available”. We do not guarantee uninterrupted or error-free performance. We do not guarantee the accuracy, frequency, or reliability of user-submitted or creator content, or that alarms will sound at the intended time.

12. Limitation of Liability

To the maximum extent permitted by law, Morning Muze is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising out of your use of the Service, including but not limited to lost data or content, missed alarms, or dissatisfaction with creator content.

To the maximum extent permitted by law, Morning Muze’s total aggregate liability for any claim arising out of or related to the Service or these Terms will not exceed the greater of (a) the amounts you paid to Morning Muze in the twelve (12) months preceding the claim or (b) one hundred U.S. dollars ($100).

13. Indemnification

You agree to indemnify and hold Morning Muze harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

15. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Agreement to arbitrate. Except as provided below, you and Morning Muze agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, rather than in court. The arbitration will be conducted in English, and judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and Morning Muze agree to bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. The arbitrator may not consolidate claims of more than one person or preside over any form of representative proceeding.

Carve-outs. This Section 15 does not apply to:

  • Claims that may be brought in small claims court, provided the claim remains in that court and seeks individual (non-class) relief and total damages of not more than $10,000
  • Claims for injunctive or equitable relief relating to intellectual property infringement or unauthorized access to the Service

Right to opt out. You may opt out of this arbitration agreement by sending written notice to support@morningmuze.com within 30 days of first accepting these Terms. Your notice must include your name, the email associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

Fees and location. Arbitration fees will be governed by the JAMS rules; Morning Muze will pay the fees JAMS designates as a business’s responsibility. The arbitration will take place in Orange County, California, or, at your election, by video or telephone conference, or at another mutually agreed location.

Severability. If the class action waiver is found unenforceable as to a particular claim, that claim will be severed from arbitration and brought in court; all other claims will remain in arbitration.

16. Modifications to These Terms

We may update these Terms from time to time. Material changes will be indicated by updating the “Effective Date” above. Continued use after changes means you accept the updated Terms.
