Copyright Policy & DMCA Notices

Morning Muze respects the intellectual property rights of others and expects users and creators to do the same. This page explains how to report copyright infringement, what happens when we receive a report, and how to respond if your content was removed in error.

Reporting Copyright Infringement

If you are a copyright owner (or authorized to act on behalf of one) and believe that content on Morning Muze infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (“DMCA”) to our Designated Copyright Agent.

To be effective, your notice must include all of the following (as required by 17 U.S.C. § 512(c)(3)):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list)
  3. Identification of the material claimed to be infringing, with information sufficient for us to locate it on the Service (such as a creator name, content title, or direct link)
  4. Your contact information, including name, mailing address, telephone number, and email address
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf

Misuse of the DMCA process — including knowingly submitting false claims — can result in liability for damages, costs, and attorneys’ fees under 17 U.S.C. § 512(f).

Email submissions are preferred for fastest processing. Notices sent to addresses other than the one above (including support@morningmuze.com) may experience delays.

Our agent is also registered with the U.S. Copyright Office. You can verify the registration at the Copyright Office DMCA Designated Agent Directory.

What Happens After You Submit a Notice

When we receive a valid DMCA notice, we will:

  1. Review the notice for completeness
  2. Remove or disable access to the allegedly infringing content
  3. Notify the user or creator who uploaded the content, and provide them with a copy of your notice
  4. Inform them of their right to submit a counter-notice

We may take additional action against accounts that we determine to be infringing, including suspension or termination.

Counter-Notices (For Content Removed in Error)

If you are a Morning Muze creator or user whose content was removed in response to a DMCA notice and you believe the removal was in error or was the result of misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g).

A valid counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and the location where it appeared before removal
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification
  4. Your name, mailing address, and telephone number
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the U.S. District Court for the Eastern District of California), and that you will accept service of process from the person who submitted the original DMCA notice or their agent

Send counter-notices to the same Copyright Agent address listed above.

What happens after a counter-notice: We will forward your counter-notice to the original complainant. If they do not file a lawsuit seeking a court order against the user or creator who submitted the counter-notice within 10 to 14 business days, we will typically restore the removed content.

As with DMCA notices, misrepresenting that content was removed in error can result in liability under 17 U.S.C. § 512(f).

Repeat Infringer Policy

Morning Muze maintains a policy of terminating, in appropriate circumstances, the accounts of users or creators who are repeat infringers of copyright. We consider the totality of circumstances when determining whether an account qualifies as a repeat infringer, including the number of notices received, the nature of the alleged infringement, and the responses provided by the user or creator.
